June 2013 – Client avoids DUI, jail, and 5 year license suspension

Quick summary of the Tampa DUI case: Client was stopped for driving on a suspended license. The reason for the suspension was because of his previous DUI conviction, just 1 year before. The Hillsborough County Sheriff DUI investigator believed that the client was impaired by alcohol, and asked him to perform field sobriety exercises. The officer detected clues of impairment on the horizontal gaze nystagmus test, the walk-and-turn exercise, and the finger-to-nose exercise. After arrest, the client declined to take the breath test. Because his previous DUI conviction was just 1 year before this arrest, the client was facing a mandatory jail sentence and a 5 year license suspension.

DUI defense: I prepared motions to suppress, and was able to use those motions to convince the prosecutor to reduce the charge to Reckless Driving.

Results: The State dropped the DUI and dropped the Driving While License Suspended charge. The client avoided both the mandatory jail sentence and the mandatory 5 year license suspension.
