June 2013 – DUI Violation of Probation Dismissed

Tampa DUI lawyer helps client avoid DUI violation of probation.

Have you been charged with violating your Tampa DUI probation? You may be able to get the violation dismissed.

Quick summary of the Tampa DUI case: Client (who unfortunately didn’t hire me for her original DUI case) had been convicted of the Tampa DUI and was now charged with violating her probation. The reason for the violation of probation was because they said she was driving on a suspended license. Normally, if you drive on a suspended license after a DUI conviction, the prosecutors will try to send you to jail, and that’s exactly what they were trying to do in this case. Client had a full-time job, so she absolutely could not go back to jail.

DUI defense: Unfortunately, I hadn’t been involved in the underlying DUI offense, so I wasn’t able to get the Tampa DUI dropped. However, I was able to perform damage control and keep the client out of jail by getting her to complete all of the terms of her probation before her VOP hearing, and then I was able to convince the judge, the prosecutor, and the probation officer to drop the VOP allegation and agree to terminate her probation successfully.

Results: Client’s probation was terminated successfully (and early), and she avoided the jail sentence.

How this helps your Tampa DUI case: If you’ve been convicted of a DUI and are charged with a violation of probation, the prosecutor will probably be trying to send you to jail. The potential jail sentence could be anywhere between 6 months to 12 months in jail for a misdemeanor offense, depending on the facts of your case and your previous record. Usually, proving a violation is pretty easy for the State, and they’ll be able to convince the judge to send you to jail. But, if you have an experienced Tampa DUI attorney at your side, you may be able to navigate the complexities of the VOP hearing, and possibly convince the judge to keep you out of jail and reinstate your probation. Every case has defenses. Some may be stronger than others, but every case has issues that can be attacked and may lead to a better resolution. Every case is different, so you should speak with an experienced Tampa DUI attorney who has the knowledge and is willing to invest the time preparing the case to see if there are any chances of avoiding jail or avoiding a DUI conviction.

If you were arrested for DUI, no matter how bad the case looks, don’t ever plead guilty without first talking to a Tampa DUI lawyer.
