April 2013 – Client avoids DUI for Xanax-related DUI

Tampa DUI lawyer helps client accused of xanax-related DUI case avoid a DUI conviction.

Were you asked to take a urine test for drugs? That test is the least reliable of the available testing procedures.

Quick summary of the Tampa DUI case: Client was stopped for driving with a broken headlight. The police officer found a bag of synthetic marijuana and began a DUI investigation. Client performed poorly on the field sobriety exercises, and was arrested for DUI. Since he didn’t smell any alcohol, the sheriff’s deputy asked client to submit to a urine test rather than a breath test. The urine results tested positive for the active metabolites in alprazolam (Xanax).

DUI defense: I prepared motions to suppress the field sobriety exercises because they are supposed to only be “validated” for alcohol consumption. I also prepared arguments to suppress the urine test results, the bag of synthetic marijuana found in the car, and all of the statements made by the client. After preparing the case for a motion hearing, the prosecutor continued negotiations and agreed to reduce the DUI to a Reckless Driving offense.

Results: Client avoided a DUI conviction, and all other charges were dropped.

How this helps your Tampa DUI case: If you were arrested for a drug-related DUI, especially if you are taking prescription medication, such as Xanax, then you need to attack every aspect of the DUI stop and seizure so that you can hopefully get the FST’s and the drug test results suppressed. If those results aren’t suppressed, then you’ll need to attack the reliability of the urine-testing process and the issues that arise with urine-testing, rather than the more reliable blood-testing. Every case is different, so it’s important to find an experienced Tampa DUI attorney who has the knowledge and is willing to invest the time preparing the case if you want to improve your chances of getting your license back and avoiding a DUI conviction.

If you were arrested for DUI, no matter how bad the case looks, don’t ever plead guilty without first talking to a Tampa DUI lawyer. There may even be a way that can get your charges dismissed, but you’ll never know unless you fight your charges by talking to a Tampa DUI attorney.
